PixMotion – Terms of Service

Thank you for choosing PixMotion. These Terms of Service ("Terms") form a legally binding contract between PixMotion ("we," "our," or "us") and you ("you" or "your") and apply whenever you access or use the PixMotion mobile application, website, or related services (collectively, the "Services").

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional policies referenced herein (including our Privacy Policy). If you do not agree, you must not access or use the Services.

Updates. We may modify these Terms from time to time. If we make material changes, we will provide notice in the App or through other reasonable means. Your continued use of the Services after the effective date of any change constitutes acceptance of the revised Terms.

1 Eligibility & Account

1. You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, whichever is higher) to use the Services. Minors require parental or guardian consent.

2. If you use the Services on behalf of another person or entity, you represent that you have authority to bind that person or entity to these Terms.

3. You must provide accurate, complete, and current information when creating an account and keep such information updated. You are responsible for all activities that occur under your account and for maintaining confidentiality of your login credentials.

2 Content

2.1 Your Content

• Input – photos, videos, prompts, or other materials you upload.

• Output – videos or other assets generated by the Services based on your Input.

Together, Input and Output are "Content." Subject to applicable law, you retain ownership of your Content.

You grant PixMotion a world‑wide, non‑exclusive, royalty‑free licence to process, store (for up to 30 days in the case of generated videos), transmit, and display your Content solely for the purpose of operating, maintaining, and improving the Services. PixMotion does not use your Content to train machine‑learning models.

2.2 Service Limitations

Due to the nature of generative AI, Output may be inaccurate, offensive, or unsuitable. You are solely responsible for evaluating Output before relying on it.

2.3 Advertising Showcase (Optional)

With your explicit in‑app consent, you may allow PixMotion to showcase selected Output in marketing materials. You can withdraw consent at any time via the App’s settings.

3 Video Handling & Retention

• Immediate Deletion of Uploads. Photos and videos you upload are deleted from active servers as soon as processing is complete.

• Generated Videos. Output videos are retained on secure servers for up to 30 days to enable re‑download or further editing, after which they are automatically and permanently deleted. You can manually delete them sooner within the App.

4 Acceptable Use

You agree not to:

1. Violate any applicable law or regulation;

2. Infringe or misappropriate any intellectual‑property or privacy rights;

3. Upload or generate Content that is unlawful, harassing, hateful, exploitative, or otherwise objectionable;

4. Reverse‑engineer, decompile, or attempt to extract source code from the Services;

5. Bypass or interfere with security, rate‑limit, or content‑protection measures;

6. Use automated scripts to scrape, harvest, or mass‑download Output;

7. Impersonate any person or entity or falsely imply association with PixMotion.

Violation may result in suspension or termination of your account, without refund.

5 Subscriptions, Coins & Payments

1. Some features are free; others require a paid subscription or purchase of in‑app coins. Pricing is shown in your app marketplace and may change from time to time.

2. Free Trial. If provided, cancel before the trial ends to avoid automatic billing.

3. Auto‑Renewal. Paid subscriptions renew automatically until cancelled via your app‑store account settings.

4. Points. Points unlock specific templates or features. Point purchases are final and non‑refundable.

5. Billing. You authorise the marketplace or payment processor to charge applicable fees plus taxes to your chosen payment method. Failed payments may result in suspension of access.

6 Third‑Party Services & Ads

The Services may display third‑party content or links. PixMotion is not responsible for third‑party sites, products, or practices. Interactions with third parties are solely between you and that third party.

7 Disclaimers & Limitation of Liability

1. The Services are provided “as is” and “as available.” To the fullest extent permitted by law, PixMotion disclaims all warranties, express or implied, including fitness for a particular purpose, non‑infringement, and accuracy.

2. PixMotion shall not be liable for indirect, incidental, consequential, special, or punitive damages, or any loss of profits or data. PixMotion’s aggregate liability shall not exceed the greater of: (a) the amount you paid in the 12 months preceding the claim, or (b) USD 100.

Some jurisdictions do not allow certain disclaimers or limitations, so they may not fully apply to you.

8 Indemnity

To the extent allowed by law, you agree to indemnify and hold harmless PixMotion and its affiliates from any claims, damages, liabilities, and expenses arising from your Content, your breach of these Terms, or your violation of any law or third‑party right.

9 Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, USA (without regard to its conflict‑of‑laws principles). Any dispute that cannot be resolved informally within 30 days shall be submitted to binding arbitration under the rules of JAMS, seated in New York and conducted in English. Class‑action waivers apply.

10 Termination

PixMotion may suspend or terminate your access at any time if you violate these Terms, create risk for us or other users, or if required by law. Upon termination, Sections 2, 4, 5, 7, 8, 9, and 10 survive.

You may discontinue use at any time and, if applicable, cancel your subscription through the app marketplace.

11 Miscellaneous

• No Waiver. Failure to enforce a provision is not a waiver of future enforcement.

• Severability. If any provision is held unenforceable, the remaining provisions remain in effect.

• Assignment. You may not transfer these Terms without prior written consent. PixMotion may assign these Terms as part of a merger, acquisition, or sale of assets.

• Entire Agreement. These Terms constitute the entire agreement between you and PixMotion regarding the Services and supersede any prior agreements.

By continuing to use PixMotion, you acknowledge that you have read and understood these Terms and agree to be bound by them.
